生物燃料技术应用监管中的法律问题研究 （硕士论文摘要） 专 业：宪法与行政法学 研究方向：经济行政法 作者姓名：王永明 指导教师：杨解君 生物燃料是生物质能的一种，是解决能源问题的新型燃料。生物燃料应用前 景广泛，可以代替传统化石燃料并实现低二氧化碳排放，以至于有效的解决全球 变暖的气候性问题。生物燃料不同与传统的石油、煤炭、核能等传统燃料，它是 一项新型的燃料，具有可再生性，是我国调整传统能源结构、保证国家能源安全、 实现国家可持续发展战略的重要保障。但是我国由于生物燃料起步晚，生物燃料 领域存在的法律问题比较突出，知识产权保护、市场竞争乃至监管等方面存在诸 多问题。本文从生物燃料现状出发，通过对其发展过程中存在的法律问题进行论 证分析，并进一步提出自己的观点以及建议。 [关键词] 生物燃料 监管机制 政策法规 I Abstract The biofuels is a new kind of biomass energy in the world, it can solve the energy problem very well in the world and it is also a new type of fuel. The biofuels has a wide application prospect, it can take the place of the traditional fossil fuels and achieve a low oxygen of two carbon emissions, so it can effectively solve the problem of climate warming. The biofuels is different with the traditional oil, coal and nuclear etc traditional fuel, it is a new type of fuel, it has the characteristics of the reproducibility, it is an important guarantee of Chinas traditional energy structure adjustment, guarantee the national energy security, and realizing the sustainable development strategy. But because of the biofuels late development in our country, there are a lot of legal issues about the biofuels field In our country, Such as intellectual property rights protection and market supervision legal problems . This paper is beginning of the current situation of the biofuels, the author propose some ideas and Suggestions by analysising biofuel development problems in our country.
