中国农村现代化与农民工劳动权益保护浅议( On the agricultural modernization and the labor right protection for peasant labors in China 马克思主义理论与思想政治教育专业2003级研究生课程班：梁卫华 【摘要】中国农村的现代化是中国现代化进程的重要部分，也是难点。促进农村富余劳动力外出务工是促进农民增加收入、从根本上解决“三农”问题的重要途径，这就涉及依法保障农民工劳动权益的问题。笔者研究发现《劳动法》对劳动者特别是农民工劳动权益的保护有不完善之处，现行劳动制度在实践中存在着企业对农民工的严重侵权问题。据此，笔者提出对法律缺陷进行立法补救、进一步完善劳动合同制度加强对农民工权益的保护、采取措施尽量缩小农民工与用人单位的不平等、把工会履行职责的重点转移到维护农民工权益上来、强化集体谈判和集体合同、进一步发挥劳动监察职能建立劳动合同申报制度、建立劳动争议处理 “裁、审分离，各自终局”的分轨体制等对策。 【关键词】农村现代化 农民工 劳动权益 依法保护 Abstract: China agricultural modernization is an important part of the course of China modernization, and a difficult point too. In order to promote peasants to increase their income and entirely solve the problem of “three agriculture”, the important way is to promote the abundant labor to work outside, which involves the problem of protecting the right of peasant labors according to law. The author finds out that there is some imperfection in Labor Law in protecting the right of labors and peasant labors in particular. I reality, there is a serious infringement act in the present labor system. Therefore, the author points out some solutions: to have a remedial legislation to the legal disadvantages, to further improve the labor contract system and enhance the protection for peasant labors’ right, to take measures to decrease the unfairness between peasant labors and employers, to turn the important point of the labor union to maintain the right of peasant labors and strengthen the collective negotiation and the collective contract, to further develop the labor supervisory function and form the reporting system of labor contract, to establish labor dispute to handle the system of separating track, in which judging is separated from trying, and ends respectively.
