摘  要  在现代行政过程法律关系中，行政主体与行政相对人的逻辑结构处于动态的均衡过 程之中，行政相对人的内部结构发生分化，众多行政相对人通过单位或组织的形式，积 极参与行政主体进而影响其行政行为的趋势日益明显。这种有组织的行政相对人的权利 与“权力”通过协商行政、契约行政等利益博弈的形式，积极地影响着行政主体的决策并 形成对行政主体的肯定性控制。公权与私权混合造成权力——权利——义务结构上重新 整合、分配，需要在法律和体制上有相应的变革与之耦合。行政过程中的这种变化不是 偶然的，有其深刻的内在驱力与外在动因。随着组织和利益集团等有组织的行政相对人 在行政过程参与的深度与广度的不断拓展，现代行政主体也正在朝多元化发展。 本文在研究方法上，由以往的静态研究改为动态考察，即贴近行政行为过程微观考 察，贴近行政利益分配状态动态考察，贴近不同行政相对人分类考察，使得行政过程中 行政相对人与行政主体的动态博弈更为直观明了。 在研究对象上，遵循“双层次、多角度、全方位”的原则，将行政相对人分为有组织 与无组织二类，由此，现代行政过程法律关系不再简单表现为“行政主体与行政相对人” 的双重利益博弈，而是在“行政主体与行政主体、行政主体与行政相对人、行政相对人 与行政相对人”之间动态的多重博弈下，实现现代行政过程利益的均衡。 在研究重点上，侧重于行政相对人对行政主体反作用之逆向考察。由于有组织的行 政相对人的介入，使得现代行政过程中行政主体组织形式发生转变，活动方式及范围亦 大为拓展，扭转了行政相对人被动服从地位，标志着传统行政过程法律关系“权力与权 利”对峙模式时代的终结，多元及协商行政时代已来临。 关键词：行政过程；利益博弈；法律控制 I Abstract In todays law relationship about administrative process, administrative subject and administrative counterparts logical structure are in the dynamic balancing process. administrative counterparts internal structure differentiated, the tendency that many administrative counterparts join the administrative subject actively through the form of unit and organization to affect its administrative action has became more evidently day by day .This kind of organized administrative counterparts rights and power affect the administrative subjects decision actively and form Affirmative control on administrative subject by the benefit games form of negotiate administration ,contract administration and so on.
