试论纳米技术的法律促进与规制-毕业论文.doc

华 中 科 技 大 学 硕 士 学 位 论 文  摘  要  纳米技术已经毫无争议的成为一种可以改变人类生活方式的革命性技术，但是纳 米技术与核技术、生物技术等新技术一样，也具有一定的危险性，需要我们认真对 待。作者首先介绍了纳米技术的起源、基础理论、概念、应用范围、各国研究发展 现状等基本情况，然后从这些分析和总结出发，抽象出了纳米技术本身独有的特点。 正是由于这些独有特点的存在，决定了对纳米技术的促进措施、危险防范原则和方 法，是不同于其他已知技术的。针对纳米技术底层工具性、不确定危险性以及道德 底线性的特征，作者提出了对纳米技术进行法律保护的若干原则和方法。其中，最 核心的原则是政府适当干预原则、禁止垄断原则和确定底线原则。在这些原则的基 础上，作者进而给出了制定纳米技术发展计划、授予纳米技术产品专利等促进措施， 以及限制带有不确定危险性的纳米技术研究、对纳米技术研究实行许可证制度等规 制措施。在这些原则、促进方法和规制方法的基础上，作者构建了纳米技术法律保 护的基本框架。 关键词： 纳米技术 规制 底层技术性 不确定危险性 道德底线 研究垄断 I 华 中 科 技 大 学 硕 士 学 位 论 文 Abstract It is no doubt that nanotechnology has become a revolutionary technology that can change human’s way of life. At the same time, nanotechnology also has the fatalness as the nuclear- technology and biotechnology. In the first instance, the author makes a survey about nanotechnology, include origin, basic theory, concept, applied area, status quo of research and so on. And then, the author abstracts the own characteristic of nanotechnology by summarizing and analyzing the above-mentioned materials. Due to its own characteristics—bottom utility, uncertain fatalness and moral obligation--we must establish a whole set of regulation and principle of research and product of nanotechnology so as to distinguish from other technology. In these principles government intervention, monopoly forbidden and ensuring boundary are the most important ones. And based on these principles the author provides a series of innovative and reasonable measures of nanotechnology legal protection, includes launching a national nanotechnology developmental program, admitting the patent of product of nanotechnology, restricting the research of nanotechnology with uncertain fatalness, performing the license system of the research of nanotechnology and so on. A whole legal protection system of nanotechnology will be set up with these mentioned regulations, measures and policies.  Key words:  nanotechnology, bottom utility， uncertain fatalness, moral obligation, regu
