 摘 要 土地征用作为一种涉及农民重大权益的措施，是指国家为了公共目的而强制取得其他民事主体的土地并给予补偿的一种制度。它是国家土地利用的一项根本制度，是建设用地的最主要来源保证。由于现行的土地征用制度形成于计划经济时代，随着社会主义市场经济体制的建立，其赖以存在的制度环境已改变，使原有计划经济时代的土地征用制度遇到了一系列新的问题，不适宜性和滞后性日益凸显。本文分析了现行土地征用制度的特点及征用过程中存在的问题，作者认为在土地征用中应该坚持六项基本原则。这些原则的建立对于切实贯彻执行我国的土地基本国策，有力地保护耕地资源，控制城市建设盲目扩张现象，实现土地资源的可持续利用具有很重要的意义。 关键词: 土地征用；特点；存在问题；原则  Abstract As a measure which relates to peasant’s significant rights and interests, land requisition is a system that the country compels to acquire the land of other civil subject for public profit and gives compensates. It is a basic system of land utilization and the most main source and guarantee of construction land. Because the present land requisition system formed in planned economy times, along with the establishment of socialist market economy system, the system environment on which the land requisition system relies for existence has already changed, which makes the land requisition system meet a series of new questions, the un-expediency and lagging are gradually obvious. This article analyzes the characteristics and existing problems of the current land requisition. The writer thinks that the land requisition should adhere to six basic principles, which has important significance to carry out basic land national policy, protect cultivated land forcedly, control the blind expansion of urban construction and realize sustainable use of land resource.
