环境影响评价制度中的公众参与

摘 要 :环境影响评价制度是一项重要的环境法律制度 ,公众参与是环境影响评价程序的关键 。公众参与能保证决策的
民主和科学 ,保障决策的行之有效 。我国的《环境影响评价法》对公众参与的主体 、对象 、范围、方式所做的规定还不能令人满
意 。借鉴西方国家和港台地区立法的先进经验 ,我们应当通过使法律具有可操作性 、协调好国家干预和公众参与 、赋予公众
提起环境诉讼的权利 、加强公众宣传 、保证信息透明等方式对其加以完善 。

Citizen Participation in the System of Appraisal On Environmental Impact

Abstract : The system of appraisal on environmental impact is an important environmental legal system. The citizen ’s
participation is the key to appraising the procedure in environmental impact . The citizen ’s participation can guarantee
democratic and scientific decisions and ensure the effectiveness of policies. The law of valuation of environmental impact
in China is not satisfactory yet concerning the subj ect , obj ect , range and method of citizen ’s participation . Using the ad
vanced experience of legislation in western countries and Hong Kong and Taiwan for reference , we should perfect it
through adopting the laws which can be operated ; coordinating state intervening and citizen ’s participation , endowing cit
izen the right of the environmental lawsuits , strengthening public propaganda
