摘 要 工程实施阶段的索赔所涉及的内容是十分广泛的，特别是国际工程，它们是综合性极强的系统性工程，应从系统论的观点出发，将索赔管理置于整个项目管理的大系统中，从合同管理、计划管理、成本管理和文档管理等四个方面分析索赔与项目管理的关系，有助于承包商从系统工程的角度去理解和进行索赔管理。承包商进行索赔分析、管理，提出有效地索赔要求，其主要目的是为了获得索赔补偿，避免不应有的损失，保护自身的权益。索赔作为工程实施阶段的重要环节，其成败与否，对承包商意义重大，它直接关系到承包商经营的成败得失，直接影响到承包商的经济效益。 在国际承包市场上，对绝大多数工程，业主都会采取选用某种标准合同条件的方法，并在此基础上与承包商签订承包合同。因此，国际惯例及所选用的某种标准合同条件都是承包商进行索赔的依据和基础。本文主要分析了FIDIC合同条件中施工索赔存在的问题、施工索赔的风险。本论文所研究的内容，为承包商合理进行施工索赔，提高索赔的成功概等方面提供了一些可行的方法和建议。 关键词： 国际工程；施工索赔；索赔问题；风险管理； FIDIC合同条件 Abstract The content involved of claim for construction stage of the project is very extensive, especially for international project,they comprehensive better systemic project extremely. We should set out from the view of the theory of the system, and put claim management in big system of the whole project management. Analysing claim project management between four respects of managing from management of the contract，planned management, cost management, documents management etc., help the contractor to understand and manage the claim in terms of system engineering. The contractor analyses, manages the claim, put forward the effective complaint, its main purpose is compensating for obtaining claim, avoid unnecessary losses, protect one’s own rights and interests. So, the claim as the most important ring in the stage of construction, mean great to contractor, it success or not, concern on contractor’s fate, influences the contractor’s economic benefits directly. At international contract market, to most of the project, owner can take and select a certain standard contract terms as a sample, and consult with contractor’s process and sign the contract on this basis, So, international practice and standard contract terms selected for use are all basis and foundation that contractors carry on the claim.
