∀ # 关于纠纷的认识, 法学界并没有 一个严格的界限, 一般是笼统地将除刑事案件之外的一 社会不
协调现象称为纠纷, 而在社会学家看来, 纠纷往往等同于社会冲突事实上, 从带有普遍性的矛盾冲突到围绕着
某 一具体权益所发生的争议, 并不是所有的这些不协调现象都和法律制度相关, 只有那些属于法律框架之内的诸
种不协调现象, 或者可以通过法律程序解决的类似现象才具有法律上的意义并非所有的纠纷都属于冲突, 也不
是所有的冲突都可以纳入法律的调整范围纠纷的主要特征在于纠纷主体的明确性纠纷双方的对抗性纠纷的
主观性和社会性以及纠纷解决上的自主性

A bstract: A s to the understanding of the d ispute, there is not a stri t a adem i boundary in the field of law. Generally
speaking, all so ial disharmon ious phenom ena ou tside of rmi inal ases are known as d isputes. In so iologist s view, the
d isputes are often equal to so ial onfli ts. In fa t, from universal ontrad i tions, onfli ts to d isputes involving a spe ifi
interest, not all the disharmon ious phenom ena are related to legal system s. On ly those in luded in the legal fram ework or
som e s mi ilar phenom ena whi h an be resolved through legal pro eedings are of legal sign ifi an e. Not all disputes belong
to onfli ts, and not all onfli ts an be adjusted in the s ope of the law. Them ajor features of disputes are the larity of
the subje t of dispu te, the on frontation of dispute betw een the parties, the subje tivity and so iality of dispute, and the au
tonomy of dispute resolution.
