This shows that the Confucian is looking forward to a Datong World of no dispute and harmonious society. In contemporary China, despite industrialization, urbanization, defamiliarization is developing rapidly, the reality that the rural area has a population of 800 million tells us thatsee the rise of bow sight social acquaintance is still an important way of living of the twenty-first century people, and the thinking of traditional Non-litigation still has a profound ideological and social basis. The purpose of this paper based on the analysis of the meaning of litigation, the causes and the basis of specific performance, also combined with the development of our country is elaborating the thinking of Non-litigation. Key words: Thinking of Litigation Harmonious Society Mediation System 引 言 中国古代在解决纠纷上，向来追求无讼是求，恕让为先的至高境界，儒家思想中的和谐伦理思想便是其产生的根源。曲阜孔庙碑刻“忍讼歌”就很好的说明了这种文化的本质，即反对冲突和对抗。正如张晋潘先生所说一样，“无讼”是儒家的理想境界。自从汉朝“罢黜百家，独尊儒术”以来，儒家文化作为一种主流文化影响了中华民族几千年来的思想理念及行为方式。于官方，这是出于统治的需要，儒家的思想更利于麻痹百姓的思想也有益于统治者的统治；于民间，这是因为儒家文化的伦理道德观念更符合人们的价值取向，更容易为大家所接受和实行。作
