商标侵权法律问题探析.docVIP

摘 要 商标法既保护注册商标又保护其项下的注册商品，但其最终目的并非仅仅保护注册商标及注册商品，而是通过保护注册商标及注册商品来保护两者在思想上的关联性，实现商标的基本功能。在全球经济日新月异的今天，商标侵权现象逐渐增多，给经济大环境的发展带来了严峻的挑战。我国的经济正在以前所未有的速度向前发展，在这样的环境下，也急需法制的完善来对其进行保护。我国新《商标法》的出台，给我国加入WTO后的经济发展注入了一针强心剂。本文从比较基本层面对商标侵权的法律问题进行了比较系统的阐述，并且结合与TRIPS协议的相关规定的比较，提出了一些关于继续完善我国《商标法》的建议。 关键词：商标权 商标侵权 TRIPS 商标法 Legal analysis on the trademark tort Abstract Trademark Law protect the registered trademark as well as protects the registered goods under it, but its final purpose does not only protect and register the trademark and the registered goods, but through protecting the theoretical relationship between the registered trademarks and the registered goods, to realize the basic function of the trade marks. Today, global economy is with rapid change, the phenomenon of trademark torts have increased gradually, that have brought the severe challenge to the development of the great environment of economy. The economy of our country is developing with a high speed which has never existed before, under such an environment, we need the completion of legal system badly to protect it too. The issue of our countrys new Trademark Law , has injected a stitch of cardio tonic into economic development after the accession to the WTO of our country. Systematic exposition that this text compares legal question that the trade mark torts from more basic aspect, and combine the relevant fixed comparison with TRIPS agreement , propose some about continuing improving the suggestion of our countrys Trademark Law .
