人肉搜索论文：人肉搜索中的隐私权保护 【中文摘要】互联网技术的高速发展,使人肉搜索作为一种搜索引擎为我们的生活带来了巨大的便利。但因其催生了许多起轰动一时的网络事件,所以到目前为止人肉搜索还存在着争议。当隐私权与人肉搜索相遇时,应当充分了解人肉搜索的特点和内容等基本情况,这样才能从法律的角度更透彻的分析人肉搜索这种新型的搜索引擎。我国是一个法治国家,我们国家的建设目标也是构建和谐的法治国家,因此就要做到平衡各种权利主体的利益。一方面完善网络隐私立法,加强对公民隐私权的保护,另一方面还要加强对网络运营商的管理,加强政府的引导和管理作用。本论文分为三部分,第一部分主要是人肉搜索侵犯隐私权的概述。通过人肉搜索、隐私权相关问题界定进一步分析二者的关系。第二部分主要论述人肉搜索侵犯隐私权的实证分析。第三部分内容是论述人肉搜索侵犯隐私权的救济。本文以人肉搜索为出发点,是对在网络环境下如何保护隐私权进行探讨,并提出相关的对策。 【英文摘要】The rapid development of Internet technology, people powered search as a search engine for our lives has brought great convenience.
