图书情报工作网刊 ·研究论文·  2008 年 6 月  2001 年～2007 年的中国图书馆法治研究 李华伟 国家图书馆数字资源部 北京 100081 吴 悦 中国图书馆学会秘书处 北京 100081 摘要:2001-2007 年图书馆法治研究文献的数量，远远超过过去 20 年的总和。在具体研究内容方面，对图书馆立法的研究以 国家层面的图书馆法和地方性图书馆法规规章为重点，但在深度上有所不足。随着 《著作权法》的修订，图书馆的合理使用 问题因其对实践的重要影响而日益成为研究热点，并随着《信息网络传播权保护条例》的出台引起相关各方关注。《政府信 息公开条例》为图书馆的发展提供了机遇，亟需强有力的研究论证作为智力支持。行业自律标志之一的 《中国图书馆员职业 道德准则》在引起业内反响的同时也激发了学者的研究热情。有关公共图书馆建设的两个 “标准”对事业科学发展具有极大 的现实意义，但研究成果在整体上仍显匮乏。其他诸如呈缴本制度、读者与图书馆的权利、图书馆评估及经费投入的法律保 障等方面，也因其强烈的实践性而成为研究的重点命题。 关键词:图书馆法治 图书馆立法 法律制度 分类号:G259.20；D920.0  Review on The Legal System of Libraryin ChinaDuring 2001­2007  Li Huawei  Digital Resources and Services Department，National Library of China，Beijing   100081  Wu Yue  Secretariat of Library Society of China, Beijing   100081  [Abstract] The number of papers that deal with the legal system of library is far more than the sum of that in the past 20 years. In  terms of details, there are much more focus on legislation of the national level and local laws and regulations, but still not so  thorough. With the amendment of Copyright Law and the promulgation of Regulations for the Protection of Information Network  Transmission Right, fair use in libraries has increasingly become of a research hotspot since its significant impact on librarypractice.  Publicity ofRegulation on Governmental Information Disclosureoffers dramatic opportunities for development of library community,  but research and demonstrability are extremely needed as intelligent support. The Criterion of Professional Ethics for  Chinese  Librarians, which is one of the signals for self­discipline of library community, not only produces an immediate reaction in practice  but also stimulates scholars’enthusiasm to further study. The two industry standards on public library construction are undoubtedly  of great practical importance for the scientific development of library community, b
