国际贸易中的欺诈与防范 摘要 本文首先分析了国际贸易合同欺诈的基本概念，续而对其进行了深入的法律分析和经济分析。在本文的法律分析部分，指出国际贸易合同欺诈是一种无效的法律行为，更是一种侵权行为，因此应从民事、行政和刑事三个方面追究其法律责任。同时，本文还进一步研究了对应的救济方法，包括自我救济、民事救济、仲裁救济、行政救济和刑事救济。在本文的经济分析部分，首先分析了国际贸易合同欺诈的主要原因，随后研究出针对不同阶段国际贸易合同欺诈的全方位的防范措施。最后，本文就未来国际贸易合同欺诈的趋势——电子合同欺诈进行了研究和探索。电子合同将成为今后买卖合同的主要载体，如何防范国际贸易业务中的电子合同欺诈，本文认为应从技术层面、法律法规等方面进行改进，从而在最大限度上降低电子合同风险，防范电子合同欺诈。 随着因特网（Internet）的迅速发展，电子商务的无限前景引起了全世界的广泛关注。迅速广泛深入发展的电子商务正在动摇和丰富着人们千百年来形成的传统商品交易方式，深刻地改变着人们的传统习惯、思维方式和思维观念。作为国际买卖贸易的载体，电子合同比传统的合同具有更好的签订条件，以其低成本和高效率性以及地域覆盖范围广的特性获得了越来越多的关注与青睐。 作为一个贸易与网络的结合应用，电子合同有着很多不成熟、不完善的地方，极易出现各种问题，成为某些不法分子用来进行欺诈的新途径，为国际诈骗分子提供可乘之机。 关键词： 合同欺诈； 法律责任； 救济； 防范措施； Study on International Trade Sales Contract Frauds Abstract Starting from analyzing the basic concept of the fraud of international trade sales contracts, this paper makes legal analysis and economic analysis in depth .In the part of legal analysis ,The paper points out the fraud of international trade sales contracts is an invalid kind of legal act ,also tortuous act .So its legal liability should be divided into three parts ,civil liability ,administrative liability and criminal liability. Meanwhile ,the paper further studies corresponding remedies ,including the remedies by their own ,the civil remedies ,the arbitration remedies ,the administrative remedies and the criminal remedies .In the part of economic analysis ,the paper first analysis the main causes of the fraud of international trade sales contracts ,then studies the all-around countermeasures for it in different phases .Finally ,the paper studies the trend of the fraud of international trade sales contracts----the fraud of electronic contract .In the future ,electronic contracts would be the main carrier of sales contracts .To prevent the fraud of electronic contract in international trade ,we should improve on the technology ,the laws and regulations etc .so as to prevent the fraud of electronic contract in the maximum limit.
