　　　　　 测谎的证据完善 摘要：测谎是一项科学的认识活动，并且广泛地应用于社会生活的各个领域，这在学界和社会实践中已经基本得到了共识。在诉讼领域，测谎已经在侦查活动中发挥了重要的作用，但对测谎能否成为证据手段，测谎结论能否成为诉讼证据仍然存在着广泛的争议和质疑。这既与测谎技术本身还有待发展完善有关，还与人们对测谎技术缺乏正确的认识从而不信任有关，尤其与我们的诉讼证据制度本身“还欠缺规范其使用的法律规则有关，这方面的理论研究基本上也处于空白状态,这同我国刑事司法中测谎检查的实践状况是不相适应的。因此，怎样从刑事诉讼的角度规范测谎检查的使用，如何评判测谎结果的证据价值，是我国刑事诉讼法学理论亟需研究的一个课题。”本文通过对证据属性的探讨，认为测谎可以完成诉讼证明中证据的本质属性—关联性证明的作用，应当纳入法定诉讼证据种类。同时，通过对测谎与诉讼价值关系的研究，总结了通过技术程序制度和诉讼程序制度规范测谎证据的合法性与真实性的问题。最后对测谎结论的证据价值进行了一定的探讨。 关键词：测谎 证据属性 诉讼认识 诉讼价值 程序规范 Abstract：As a scientific activity of cognition, criminal polygraph test has been extensively applied to social life, which has gained basic recognition in both academic circle and social practice. In the realm of litigation, criminal polygraph test has already played the important role in investigating activity. But as to whether criminal polygraph test can be the proof means and whether its conclusion can be the litigation proof, people still have extensive disputes. This is not only relevant with the need of further development of criminal polygraph test technique, but also relevant with people’s distrust of criminal polygraph test due to the lack of knowledge, and especially relevant with our litigation proof system’s “lack in legal rules regulating its use and the theoretic research is almost blank, which fail to keep pace with the practical situations of criminal polygraph test in our criminal justice. Thus, how to regulate the use of criminal polygraph test from the perspective of criminal procedure and how to evaluate the proof value of the result of criminal polygraph test are the subjects needing research in the theories of our criminal procedure law.” Through discussing the characteristic of evidence, this article takes the viewpoint that criminal polygraph test obtains the characteristic of relevance which is the nature of evidence in litigation proof, so that it should be ranked into the legal category of litigation proof. Meanwhile, through the research on the relation between criminal
