我国大规模侵权损害赔偿问题探究 【摘要】近些年，大规模侵权案件不断涌现在公众的面前，引起了社会和政府的极大关注，学术界对此的研究也在不断地深入。但是目前我国的立法却还未对大规模侵权进行相应的立法规范，即仍处于立法空白的状态。然而大规模侵权案件出现在生产社会化与科技迅猛发展的背景下，其体现出来的利益需求与保护也是新时代社会公众的要求。大规模侵权案件相比传统侵权纠纷来说存在着受害人数巨大，诉讼成本高、耗时久，损害赔偿复杂等特点与难点，以至于我们无法忽视它的存在，有必要对其进行针对性研究。笔者着重把大规模侵权及其损害赔偿的产生原因、概念、特征等理论层面与立法上的不健全、司法实践的困难、现实中的举步难行等现实实践层面相联系。通过对已有救济模式的选择，寻找适合我国国情且符合我国特色社会主义发展方向的途径，以望对我国发展与侵权法的完善尽绵薄之力。 【关键词】大规模侵权 损害赔偿 救济赔偿基金 The exploration to the compensation problem of mass tort in China 【Abstract】In recent years, the cases of mass tort continue are constantly emerging, which causes the great attention of the society and government as well as the study constantly in-depth of the academia. However, the legislation of our laws has not regulated mass tort, thus is still in legislative gap. The cases of mass tort mass tort appear under the background of the socialization of production and the rapidly development of science and technology, reflects the requirements of interest and protection, which are also the demands of public in the new time. Comparing with disputes of traditional tort, the cases of mass tort have many features and difficulties, such as a great number of victims, high-costing and time-consuming lawsuit, complicated damages, etc. which could not be ignored and on which it is necessary for us to carry on targeted study. The thesis emphasizes the combination of the theories of the reasons, concepts, characteristics of mass tort and its damages with the practices of incomplete legislation, difficulties in judicial practice, painful lurches in reality. Through the selection of the existing relief patterns, the thesis tries to find the ways which adapt to the Chinese situations and are accordant with the orientation for development of socialism with Chinese characteristics.
