论政府在行政强制中的权限 摘 要 政府作为我国的行政机关，行使一切行政权力。不加以限制的权力就是滥权，对政府权力的规范和限制与赋予政府权力一样的重要。行政强制是政府行使行政权力的表现，在所有的行政行为当中，行政强制属于运用国家机器的强力来直接干预公民活动的一种严厉的手段。在行政强制中规范政府权力显得尤为重要。本文从政府的概念、职权出发，指出行政强制是政府的一项重要职权。然后分析行政强制的性质和意义，得出行政强制是国家进行行政管理活动中不可或缺的制度。结合政府与行政强制两者的关系，分析指出政府是行政强制的主体，政府有效行使行政强制权力对维护公平正义、保障公民的合法权益和社会的长治久安具有重要作用和深远的意义。最后提出自己的观点：应该充分赋予政府行政强制的权利，同时设置必要的行政救济监督政府权利的行使，从而保障行政相对人的合法权益和社会的稳定。 关键词 政府； 行政强制； 权限； 救济 abstract The government as Chinas administrative organs, exercise all executive powers.
