法律硕士学位论文评阅参考标准 万方数据  法 律 硕 士 专 业 学 位 论 文 刘代伟集资诈骗主观目的的认定 The cognizance of Liu Daiwei fund-raising fraud subjective purpose  作 者 姓 名： 指 导 教 师：  唐宗歌 袁 林 教授  西 南 政 法  大 学  Southwest University of Political Science and Law 万方数据 内容摘要 近年来我国民间资本市场的发展促进了资本流通，活跃了市场经济。但是民间资本 市场发展缺少规范和监管，以民间融资为名的集资诈骗犯罪日益猖獗。集资诈骗犯罪严 重侵害了公私财产所有权，扰乱国家金融管理秩序。作为金融诈骗犯罪中危害最为严重 的集资诈骗罪，涉案金额往往巨大，受害人数众多、分布范围广，被害人经济损失惨重， 甚至会失去赖以生存的基本物质条件。为此，司法实践中应当对集资诈骗行为准确定性， 依法打击。但是无论在刑法理论界还是司法实践中，对集资诈骗犯罪认定还有需要探讨 的地方。 本文分为四个部分，以刘代伟集资诈骗案为例，提出认定集资诈骗罪争议焦点问题， 详细分析刑法理论界对争议焦点的不同观点以及司法实践中存在的问题，进而提出认定 集资诈骗罪非法占有目的理论分析和司法推定的方法。 第一部分介绍刘代伟集资诈骗案的情况。通过对刘代伟案基本案情的分析，介绍了 对该案的有争议的处理意见，进而提炼出本文拟研究的焦点问题是非法占有目的认定。 第二部分是对集资诈骗主观目的认定的基本法理分析，着重从抽象的角度分析非法 占有目的内涵、构成要素、认定主观非法占有目的需要考虑的因素。最后提出认定主观 非法占有目的方法。 第三部分是将理论与案情具体结合，分析刘代伟主观上产生非法占有目的时间、认 定要素和司法推定。此部分通过对刘代伟案例的分析，结合了理论分析和司法推定进行 具体案件应用。 第四部分是在以上三个部分论述的基础上，分析处理集资诈骗案件时如何从理论和 实践两个方面，结合法理分析和司法推定综合审查认定集资诈骗罪非法占有目的。 关键词：集资诈骗；非法占有目的；司法推定 1 万方数据 Abstract In recent years, development of the private capital markets to promote capital flows, active in the market economy.
