Classified Index: U.D.C.:  CODE: 10075 NO: The tolerance of the law in our country Candidate: Xue shan Supervisor: Li hongying Hou fengmei Academic Degree Applied for : Juris Master Specialty : Juris Master（Law） University : Hebei University Date of oral examination : June , 2013 摘 摘  要 要  我国是人民民主专政的社会主义国家，人民民主专政的本质是人民当家作主。法律 作为一种社会规范，它最终的目的，并不在于惩罚我国公民，而在于修复，它通过自己 独特的运行方式让被破坏的社会关系得以弥补恢复，让失衡的社会秩序恢复平衡。可以 说，它与道德等其它社会规范殊途同归，最终的目的都在于创造社会的和谐。从我国目 前的法律现状来看，在法律条文、法律原则和法律宽容之间，法律更注重法律条文，法 律原则等，学者对法律宽容的研究甚少，而笔者认为我国的宽容思想源远流长，从其产 生之始就是与法律宽容紧紧地联系在一起，笔者在这里所讲述的法律的宽容性是从公民 的角度来阐述我国法律的宽容性，法律的宽容性就是指法律所包容的有“度”的自由。 本文先从宽容到法律宽容两个层面阐述我国法律的宽容性的概念，然后从立法、执法、 司法、守法四个层面论述我国法律宽容性的表现，再从立法、执法、司法、守法四个方 面来论述我国法律宽容的不足与解决。  关键词  宽容  法律的宽容  司法公正  法制教育  I Abstract Abstract Peoples Republic of China is a socialist state of the peoples democratic dictatorship, the nature of the peoples democratic dictatorship, the people are the masters.As a social norm, the ultimate goal of Chinese Legal System is not punishment, but repairmen. Through its own unique mode, the damaged social bonds could be made up and the imbalance social order could back to track. That is to say, like Code of Ethics, the Legal system canachieve an equal finality with other social norms, which is to create a harmonious society. As for the legal status in China, the legal system mainly focus on the provisions and principles butrelatively little concerns about Statute Toleration, even scholars also are lack of comparative studyabout Statute Toleration. As far as I think, Chinese traditional toleration thinking is connected with Statute Toleration at the very beginning, but the Chinese Statute Toleration stated below stands on nationals’ feet and is regarded as a kind of Statute freedom “degree”. In the beginning of this thesis, Chinese Statute Toleration is defined with toleration and Statute Toleration. And then, Statute Toleration is displayed with four segments which are legislation, law enforcement, and justice
