网络犯罪立法研究 摘 要 随着互联网在人们生活中的广泛应用，我国的网络犯罪数量也呈现出逐年增加的趋势，这已经成为社会关注的焦点问题之一。正是在这种背景下，网络犯罪立法变得刻不容缓。从目前国内网络犯罪立法的状况而言，许多问题缺乏法律依据，得不到法律上的正式回应。集中表现在执法实践中对网络犯罪的定义不清晰，造成取证难，判刑难，最终使得很多网络犯罪事件无法得到公正处理。针对这种状况，我们必须加强对互联网的立法研究，尽快健全打击网络犯罪的法律体系，切实提高依法预防和打击网络犯罪的能力，处理好网络犯罪的相关问题。 论文整体分为六个部分，第一部分是充分阐释了选题的意义和选题背景。第二部分是对互联网和网络犯罪进行了定义。并对网络犯罪和计算机犯罪进行了比较，两者的特点进行了阐释。第三部分是网络犯罪立法现状，通过具体的实例对网络犯罪发展情况进行具体的研究，从网络犯罪的立法进行分析，从历史到发展进行研究，然后从实际犯罪立法情况及国外和国内的网络犯罪入手，分别举出多个基本实例，进行分析，分析其产生的问题，提出解决办法，对网络类型犯罪进行研究，分别以网络为对象，以网络为工具以及网络财产问题，三个问题进行分析。第四部分是研究我国法律存在的不足，主要从网络犯罪侵犯的客体不明确、网络犯罪缺乏单位犯罪的相关规定、网络犯罪的刑罚种类单一三个方面入手进行解析。第五部分是完善网络犯罪的立法提出对策。最后全文进行总结。 本文针对目前网络犯罪问题较为严重现象,从网络犯罪形成原因、表现形式、解决对策三个方面 ,研究网络犯罪问题和网络法律问题 ,并提出了解决此问题的方法与对策。CYBERE CRIME LEGISLATION RESEARCH abstract With the wide application of the Internet in peoples daily life, the number of Chinas Internet crime has increased year by year, it has become one of the focus of social problems.
