New Insurance Law establishes the system of insurance apparent agency by the
way of NPC’S legislation for the first time，which will play a positive role in
furthering the rights and obligations between the insurer and the insurance agent in
the insurance agency relations，balancing the interests of the insurer and the insured
and enhancing the trust level ofChina’S insurance industry．As far船the study method
is concerned，on the one hand，this thesis adopts the deduction methodfrom
common to special，analyses the characteristics of insurance apparent agency on the
basis of the general theory of apparent agency．on the other hand，this thesis closely
integrates the theoretical analysis with demonstration study．Specifically speaking，
this thesis also inducts the analysis of many eases combined丽th insurance practice
when it discusses the basic theory,which provides sensible pilot and proof for the
thorough understanding ofthe meaning ofinsurance apparent agency system．
This thesis is made up offour chapters．The main content ofeach chapter follows

Chapter one introduces the basic theory ofapparent agency which includes sevan
aspects：the definition and essence of apparent agency,the historical background of
the birth ofapparent agency system，the comparison ofthe apparent agency system of
