摘 要 加入WTO以后，我国市场经济建设开始全面与国际接轨，工程承包领域是与国际同业接触较早、较频繁的行业之一。在不断地碰撞中，我国工程项目由计划安排到承包发包，由下达任务书到签订承包合同，由自拟式合同到统一格式合同，继而到国际标准合同文本；合同的作用也由经济契约发展为工程管理方式，FIDIC合同条件得到越来越多的使用。 然而，FIDIC合同条件管理模式与我国传统的管理方式有很大的不同，加之我国法制建设和步入市场经济的时间较晚，因而在实践中暴露出一些问题和不适应之处。这就提出了一个课题，FIDIC合同条件有哪些特点，能否适用于我国，需要解决哪些问题，发展前景如何？ 本文概括地介绍了FIDIC组织及由其编制的FIDIC合同条件，结合我国工程领域的现实状况分析了FIDIC合同条件在我国应用中存在的问题，并有针对性地提出了一系列相关对策。 关键字：FIDIC合同条件，合同管理，索赔，仲裁 Abstract With the entrance to WTO, market economy construction of China begun to connect with the world, in which project contracting is one of the earliest who are involved with international contacts frequently. In constant communications, the Chinese engineering project has been transformed from planed arrangement to contracting out, from issuing assignment to signing contracting agreement, from self-designed contract to standard contract, finally to international standard contract; the use of contract has also been developed from simple economical agreement to project management methodology. The use of FIDIC contract conditions is become more and more popular. However, management style of the FIDIC contract conditions is quite different from the traditional management style in our country. As to the delay of legal construction and entrance to market economy, there have encountered some problems in the practice. There comes a subject, i.e. what are the characters of FIDIC contract conditions? If these characters applicable to China? How the future will be? This article briefly introduced the FIDIC organization and the FIDIC contract conditions that it designed. Based on the current situation of engineering project area in China, this article analyzed the problems in the application of FIDIC contract conditions, and proposed relevant measures accordingly.
