Japan claims sovereignty of the Diao-yu islands are mainly based on occupation, prescription, and the San Francisco peace treaty did not ask Japan to surrender sovereignty of the Diao-yu islands, etc. For these so-called basis, China put forward that before the sino-japanese war of 1895, China has obtained the sovereignty of the Diao-yu islands, and modern international law and international practice does not recognize prescription, which is the traditional way of territorial change, and without Chinas participation,the San Francisco peace treaty has no legal force to China, and Cairo declaration and the Potsdam Proclamation should not be denied, etc. There is no doubt that China has the sovereignty of the Diao-yu islands, but now,Japan takes control of the Diao-yu Islands.The Diao-yu islands dispute in the future may appear to the following situations:maintain the status quo,diplomatic negotiations to solve, resort to force to solve or legal solutions to solve .For these, our country should be fully prepared.
