民间验房师：现实角色尴尬与合理法律定位 何 静 （南京农业大学，江苏 南京 210031） 【摘 要】 近年来频繁爆发的商品房质量危机验证了现行建设工程质量监管机制的不足，为了维护自己的合法权益，购房者转向寻求验房师的帮助，验房师因此深受市场欢迎，但是由于没有得到政府的承认而陷入尴尬的境地。在政府职能转变的背景下，由验房师承担部分监督职责符合改革的趋势，满足了市场需求，与商品房交易关系的本质也相契合。基于此，法律有必要承认验房师的合法地位。法律应该赋予验房师以独立的第三方身份，同时，建立验房师职业资格考试制度和惩戒机制，引导验房行业健康发展。 【关键词】 验房师； 验收交付； 角色； 法律地位 The Folk Home Inspector: an Real Embarrassment and Reasonable Legal Characterization He Jing (Nanjing Agricultural University, Nanjing 210031, Jiangsu, China) Abstract: The existing project quality control mechanisms has been verified inadequate by frequent outbreaks of commodity housing crisis in recent years. In order to safeguard their legitimate rights,the buyers turned to seek the help from the Home Inspector, therefore, them are received by the market. However,they fall into an embarrassing position because ofthe absence of recognition by the government. In the context of transforming the government functions,it is consistent with the trend of reform that ome made the Home inspector undertake supervision responsibilities, meeting the market demand alsofitting the nature of the real estate transaction. For this reason it is necessary to recognize the legal status of the Home inspector in the law. The Home inspector should be given legal division as an independent third party in the law,at the same time, establish of the Home Inspector Qualification Exam system and disciplinary mechanisms to guide the healthy development of the Home Inspection industry.
