浅议我国夫妻财产约定制度之完善 法学专业学生 柯梦 指导教师 罗良 摘要：夫妻间的财产关系是婚姻关系的一项重要内容，随着社会经济的发展，仅依靠法定财产制已不足以调整夫妻在财产方面的权利、义务关系，新的婚姻法对夫妻财产制度作了重要的修改和完善，明确规定了夫妻财产约定制度，即在私法领域给予当事人充分的自由，允许其在法律规定的范围内自主处分其财产权利，以避免夫妻财产纷争，维护社会稳定与团结。本文从约定财产的历史、可行性、公示制度、效力等方面阐述我国夫妻财产约定制度，并针对我国夫妻财产约定制度存在的缺陷提出了一些观点，以促进我国夫妻财产制度的完善。 关键词：夫妻；约定财产；效力 On the Systematical Consummation of the Chinese Marital Property Agreements Student majoring in law KE Meng Tutor LUO Liang Abstract: Property relations between husbands and wives are a marriage ties important content, along with social economys development, only depends upon the legal property system to be insufficient to adjust the husbands and wives in the property aspect right, the voluntary relations, the new marriage law has made the important revision and the consummation to the husbands and wives property system, had stipulated explicitly the husbands and wives agree the property system, namely gives the litigant in the civil law domain the full freedom, allows it to punish its property right independently in the legal rule scope, avoids the husbands and wives property dispute, maintains the social stability and the unity. Key words: couple；arrange property；validity夫妻财产制度又称婚姻财产制，是关于夫妻婚前和婚后财产的归属、管理、使用、收益、处分以及债务的清偿、婚姻解除时的清算等方面的法律制度。随着经济社会的发展和人们婚姻家庭观念的变化，夫妻间财产制度出现了约定财产制，约定财产制是指法律允许夫妻用契约、协议的方式对他们在婚前和婚后财产的归属、占有、管理、使用、收益和处分以及对第三人债务的清偿、婚姻解除时财产的分割等事项做出约定，从而排除或部分排除夫妻法定财产制适用的制度，其效力要高于法定财产制，只有在当事人未就夫妻财产做出约定，或所做的约定不明确，或所做的定无效时，才适用夫妻法定财产制。我国约定夫妻财产制于1930年国民党政府《亲属编》始有规定。按其规定，夫妻得于婚前或婚后以契约形式约定夫妻财产制（须在法律规定的共同财产制、统一财产制和分别财产制中选择其一）；该项契约的订立、变更或废止，非经登记不发生对抗第三人的效力。1985年台湾民法《亲属编》被修订后，简化约定财产制为共同财产制与分别财产制两种类型。成立后，19
