本科毕业设计（论文） 经济法视野下的我国房地产调控制度研究 学 院 专 业 年级班别 学 号 学生姓名 指导教师 2014 年 10 月  摘 要 近年来我国房地产价格持续升温，房价一直是民众的热门话题。自1978年改革开放后，我国逐步建立了房地产市场相关的法律制度，但没能成功阻止房地产市场秩序的混乱；近些年我国政府针对房地产的各个开发、销售环节发布了很多调控政策。通过现有法律制度及相关政策研究政府的房地产市场调控行为，可分析出政府在调控过程中的“政治人”与“经济人”的双重角色，以致调控行为不能形成合力，取不到预期效果。政府应在经济法的视野下合理定位，遵循调控法定与调控适度的原则，让调控主体相与协调、完善调控主体的法律责任，同时完善房地产相关的税收法制，真正发挥税法在房地产市场上的宏观调控功能。 关键词: 经济法，房地产调控，政府定位 Abstract In recent years,?Chinas real estate prices?rising,?house prices?has been a hot topic in?the public.Since 1978?after the reform and opening up,?China has gradually established a?real estatemarket related?legal system,?but?failed to?prevent?the real estate market order?confusion;?in recent years our government?each?development,?sales link?for real estate?issued a regulatory policy.?Through?the regulation of the real estate market?behavior of?existing legal?system and relevant?policy research?of the government,?the dual role of?the government?in the regulationcan be analyzed?in the process of political?man and economic man,?so that the?control behavior?can not?form a cohesive force,?cant get?the expected effect.?The government?should be a reasonable position?in?the field of economic law,?the regulation of?legal?and regulation?to follow?the principle of moderation,?make?the legal responsibility?regulation subject?andcoordination,?improve the?regulatory?body,?at the same time,?improve the real estate?related taxlaw,?tax law?really?play?macro-control?in the real estate market?control function.
