 毕 业 论 文 题 目 同性婚姻合法化研究 摘要 伴随社会的快速发展，现实中的许多现象正游离法律之外等待法律的规制与认可。“同性婚姻”是这诸多现象之一，而近年来学术界对同性婚姻入法却各说其词，各持观点。目前国外已有一些国家将其合法化，但在我国提案还没有通过。鉴于我国目前同性恋的历史及现状，同性婚姻入法既有其必要性也有其可行性，并借鉴西方已有法律的规定来制定我国相关法律，以更好的保护同性恋这一群体的合法权益。 关键词：同性恋； 同性行为； 同性婚姻； 同性伴侣关系 Abstract With the rapid development of the society, there are many phenomena dissociating outside the law to wait for legal regulation and recognition, “homosexual marriage” is one of the phenomena, while in recent years the academic community held different opinions about the same-sex marriage into law .Currently there are some foreign countries legalize it, but in our country the proposal has not yet passed. In consideration of our history and current status of homosexuality ,same-sex marriage into law is necessary and has its feasibility , learn from the law existed in the West can use for reference to develop Chinas relevant laws to better protect the legitimate rights and interests of gay this group.
