摘要 电子商务的一个重要问题是确保网络交易支付的安全性、有效性。电子支付与电子商务密不可分，它构成了整个电子商务活动中最核心、最关键的环节，是交易双方实现各自交易目的的重要一步，也是电子商务得以发展的基础条件。电子支付并不仅限于消费者购物后的支付过程，还包括银行或其它发行机构的责任问题以及随着互联网而出现的各种电子支付工具及资金划拨系统等问题。在电子支付中，交易各方最关心的就是支付的安全性。国际间正尝试建立可为各方所接受的电子支付制度，以积极应对可能发生的各种法律问题。 当前我国电子支付的立法严重滞后于金融电子化的步伐，研究和参照国际相关立法完善我国该领域的法律规定己迫在眉睫。本文从电子货币、网络银行和电子资金划拨等方面介绍了目前电子支付的发展现状，探讨了电子支付对传统支付方式的冲击，并详细阐述了国外有代表性的法律规定。最后，结合目前我国电子支付领域存在的实际问题和立法现状，借鉴国外先进的法律规定，提出了健全我国电子支付法律制度的立法建议。 关键词:电子支付电子货币网络银行电子资金划拨 Abstract An important question of e-commerce is the safety and effectiveness of payment. Electronics payment cannot be divided from e-commerce. It forms the nucleus and the key link of the whole e-commerce in the activity, It is one of the important business purpose, and the foundation condition of e-commerce. The electronics payment is not only confined as the payment course behind, and still includes the duty of bank or other organization as well as various electronics payment tool and payment system that have appeared along with the Internet. What each side concerned about most is the safety in electronics payment. In order to solute the various law questions that should occur probably, the I7N is trying building the electronics payment system that can be accepted by all countries. At present, laws of our country about electronics payment cannot meet finance electronization. We should research relate international law regulation, and perfect the law regulation of this domain extremely. in the thesis I introduce the development situation of the electronics payment from electronics money, network bank, and electronics payment, analyze the impact to the tradition payment, and expatiate the representative abroad law regulation. Finally, combining with the actuality of our country electronics payment system, and using for reference the advanced law regulation abroad, I put forward the advice of perfecting our country electronic payment regulation.
