用益权的源流及其在我国民法上的借鉴意义 屈茂辉 湖南大学法学院 教授 　　关键词: 用益权/他物权/物权 　　内容提要: 用益权作为用益物权的一种重要类型，为西方国家所固有;现代用益权较之传统用益 权在客体、内容、基本功能等方面都发生了较大的变化。我国民法可以借鉴用益权这个 “壳”规定企业用益权、自然资源用益权、空间用益权。 As an important kind of usufructuary right,usufruct is already existed in　west countries.Compared with the traditional usufruct,modern usufruct has ch anged greatly in such aspects as object,content,basic function and others.Th e usufruct can be used for stipulating the enterprise usufruct,natural resou rce usufruct and space usufruct in Chinese civil law.usufruct、jura in re aliana、jus ad rem 　　用益物权作为他物权的一种重要类型，一般认为乃大陆法系国家民法所固有。近年来
