The German and USA Legislative Frameworks for DisastersExecutive summary：This report provides a brief description of the state of emergency and budget allocation and implementation of the existing legal and institutional framework of two countries in disaster and emergency situations. A large number of the applicable laws in the state of emergency, is extensive, can put forward a compelling reason, the subject of separate papers. They include physical planning, environmental management, public health, and infrastructure of law. However, in this study, the focus of the law is applied directly to the state of emergency, including the provisions of the Constitution and the law. The study also examined in performing their duties, the institutional framework for disaster and emergency management. Most of these organizations are government agencies, and some organizations for them, the government is the sole shareholder. Their mission is national, but they are responsible for client ministries and departments to provide services. Institutional framework, non-governmental organizations, professional groups, and community-based organizations, play an important role in disaster and emergency. These institutions, especially the strength of the competitive advantages - scientific, technical, business, awareness raising and education - which makes it the implementation of some important aspects of disaster and emergency management.
