Abstract The system of punitive compensation is a system of liability to pay compensation for damage from Anglo桝merican law system.At present,China has been establishing the system in the legislation.However,there are geave defects in the relevant legislation.So the function that the system contain delicts with punitive compensation cannot be fulfilled.This paper will begin by analyzing the value of the system of punitive compensation,combine the legislate present situation,point out the defect,use the relevant legislation advanced experience of other countries and TaiWan Prefecture for
