河北经贸大学毕业论文 浅谈如何保障刑事证人的安全 专业名称: 法 学 班 级 2004级2班 学生姓名： 杨俭峰 指导教师： 包 雯 完成时间： 2008年 4月 摘 要 自从刑事诉讼法实施以来,证人不愿出庭作证一直成为困扰司法实践部门的难题。我国目前对刑事证人安全保护方面的立法还很薄弱,没有具体的保护措施,没有专职的保护人员和行之有效的操作机制,对证人的保护只停留在事后保护、人身保护和宣言式保护范围内,侧重于事后对伤害证人的行为实施惩罚,忽视对证人事先预防性的保护等等。因此有必要进一步完善证人安全保护制度。本文通过对刑事证人的概念和范围进行确定，然后借鉴国际社会和国外一些国家关于刑事证人安全的立法概况，并对我国刑事证人安全的立法现状进行分析，最后得出要保障我国刑事证人的安全应该做到以下几个方面。首先，要确定刑事证人保护的对象和范围，这样有利于司法机关有针对的开展工作；其次，要设立证人安全保护的专门机构，以便使证人的安全得到切实的保障，这样也可以防止一些国家机关互相推卸责任；最后，要建立一系列的刑事证人保护措施，比如: 身份保密制度, 建立特殊证人的贴身保护制度和作证后保护制度，诉讼程序上的保护制度等。只有建立一系列确实可行的保护刑事证人的措施，才能使刑事证人的安全得到切实的保障。 关键词：刑事诉讼法；刑事证人；安全；刑事证人保护措施；Abstract Ever since the criminal procedural law implement, the witness doesnt wish to appear at court to testify to have been become the hard nut to crack that the judicatory practices a section. Currently our country protects the lawmaking of the aspect to the crime witness safety still very weak, have no concrete protection measure, have no full-time protection personnel and effective operation mechanism, stay around after the event protection, the human body protection and the declaration type protection scope to the witness protection inside, lay particular emphasis on the after the event punishment to the injury witness behavior implement, neglect to prevent from in advance to the witness of protection etc .Therefore, we have the necessity further perfect witness safety protection system. This text carries on an assurance to the crime witness concept and scope, then draws lessons from international little bit social and foreign nations a witness the lawmaking general situation of the safety concerning the crime, and analysis to our country pertaining to crime witness the lawmaking present condition of the safety.
