xxx University 2015届本科生毕业论文（设计） 题 目 农村土地承包经营权流转制度的构建 院 别 法学院 专 业 法学　 学生姓名 XXX　 学 号 1105010XX 年级 2011 级 指导教师 xx 　 职称 教授 教务处制表 2015年 5月 5 日  摘要 农村土地承包经营权是关系到农民、农村乃至农业发展的重要的一项权利，它赋予了农民对所承包土地占有、使用、收益以及一定处分的权利。其中，农村土地承包经营权的流转，作为处分权利的一种，密切关系着农村土地资源的合理配置和开发利用。但目前我国尚未建立完善的农村土地承包经营权流转的专门法律制度，因而该项权利在行使过程中面临诸多障碍。本研究将通过阐释农村土地承包经营权流转的相关定义，揭示出其本质，并进而剖析现有流转模式中存在的问题，全方位探寻问题存在的根源，提出从法律角度构建健全的农村土地承包经营权流转制度的建议。 关键词：土地所有权；土地承包经营权；权利流转；法律制度构建  Abstract The right of contractual management of rural land ,is the important right of the relationship between farmers, rural and agricultural development, which gives the farmer the right to possess, use, profit and dispose. Among them, the circulation of the right to the contracted management of rural land, as the right to dispose ,closely relate to a rational allocation of rural land resources and development utilization. But at present, China has not yet established a perfect legal system of rural land contractual management rights transfer, and thus the right to exercise facing many obstacles. This study will explain the definition of the right to contracted management of rural land circulation,reveal its essence, and then analyzes the problems in the current transfer mode, give the root of problems a comprehensive exploration, put forward suggestions to improve the rural land contract and management rights and consummate the current system.
