技术侦查中狱侦耳目问题研究 中文摘要 目前，狱侦耳目手段在我国刑事司法实践中广泛运用，然而，狱侦耳目的概念和性质在立法上尚未有清晰合理的界定，关于狱侦耳目的法律规定也很缺乏，导致其在实际运作中产生一系列问题，违法滥用现象严重。本文通过对狱侦耳目的研究和分析，厘清狱侦耳目的概念和性质，找出实践中存在的突出问题，并提出完善狱侦耳目手段的建议。本文分为三大部分。第一部分对狱侦耳目的性质进行界定，通过狱侦耳目和技术侦查两者之间概念的联系，找出契合点，将狱侦耳目纳入技术侦查措施的范畴；第二部分重点讨论狱侦耳目在刑事司法中存在的问题，包括主体、适用案件范围、搜集的情报是否可以作为证据使用、如何作为证据使用等；第三部分提出完善狱侦耳目手段的建议，包括：将狱侦耳目手段纳入技术侦查的范围、完善狱侦耳目所获证据资料的排除程序、完善狱侦耳目的监管制度。 关键词：技术侦查；狱侦耳目；性质；问题；主体；案件范围；证据；建议 Study on the Problem of Intelligencer in Prison System of Technological Investigation ABSTRACT Nowadays, the method of intelligencer in prison system is widely used in criminal investigation practice in our country. However, the notion and nature of the intelligencer in prison system has not been clearly and properly determined in legislation yet, and laws and regulations about it is inadequate, which arouses a series of problems during its implement, including unlawful abuse. This article studies and analyses the method of intelligencer in prison system, and makes its notion and nature clear, finds its prominent problems in practice, puts forward suggestions towards improving the method of intelligencer in prison system. This article is divided into three parts: The first part defines the nature of the intelligencer in prison system through the relationship between the notion of the intelligencer in prison system and that of technological investigation by discovering their similarities, therefore includes it into the territory of technological investigation; The second part mainly discusses the problems of the method of the intelligencer in prison system in criminal investigation practice, including intelligencer identity, cases that could apply it, whether intelligence obtained in this way can be used as evidence and how.
