HCMA 406/2009 HEADNOTE The scheme of the Rehabilitation of Offenders Ordinance, Cap. 297 is that the availability of a spent conviction is based on what the courts consider to be the appropriate sentence. Such a statutory scheme would be undermined if not overthrown if the courts were to impose less than the appropriate sentence so as to make spent convictions available. It is stated in the particulars of offence that the infringing copies were of two computer programmes.
