28例医疗纠纷起诉案件特点分析 　　[摘要]目的 了解山西省医疗纠纷起诉案件的特点，为预防医疗纠纷，保护患者和医务人员的权益提供借鉴。方法 综合应用文献分析法和统计学方法收集、整理中国裁判文书网中与本研究相关的28个案例（2012年1月～2016年4月），侧重分析医疗机构被起诉的原因、过错参与度、赔偿金额等情况。结果 山西省医疗纠纷起诉案件主要发生在太原和山西省南部；医疗机构等级越高，其在案件中的过错参与度越低，赔偿金额越高，起诉到判决耗费的时间越长；二甲医院被起诉的主要原因是误诊，三甲医院被起诉的主要原因是治疗不足；以死亡为结局的患者获得的赔偿较以伤残为结局的患者多。结论 二甲医院应通过培训提高医务人员的专业技能，三甲医院通过总结经验、制定处理预案，保护患者身体健康权利，预防医疗纠纷发生。 　　[关键词]医疗纠纷；特点；起诉案件；分布 　　[中图分类号] R197.32 [文献标识码] A [文章编号] 1674-4721（2016）10（b）-0141-03 　　[Abstract]Objective To understand the characteristics of medical dispute prosecution cases in Shanxi province，and to provide reference for the prevention of medical disputes，protection of the rights and interests of patients and medical personnel.Methods 28 cases （from January 2012 to April 2016） related to this study of Chinese referee instruments net were collected and arranged by comprehensive using literature analysis and statistical methods.Reasons for the prosecution of medical institutions，fault participation degree and amount of compensation were focus analyzed.Results Cases of medical disputes in Shanxi province mainly occurred in Taiyuan and the southern part of Shanxi province；the higher level of medical institutions，the lower fault degree of participation in the case，the higher amount of compensation and the longer time the decision to prosecute；the mainly reason that Two grade hospitals were being sued was the misdiagnosis，while mainly reason that Three grade hospitals were being sued was inadequate treatment；compensation for patients with death as the outcome were more than those with disability.Conclusion Two grade hospitals should improve the professional skills of medical personnel through training and Three grade hospitals through summary experience， developing plan to deal with the protection to protect the patients′ health right and prevent medical disputes. 　　[Key words]Medical dispute；Characteristics；Prosecution case；Distribution 　　目前我国医患关系紧张，暴力伤医事件频发。其最主要的原因是医疗资源分布不均，医务人员超负荷劳动，患者对医疗行业、医学科学认识不足等[1]。因此国家
