网络侵权的基本意义探讨.doc

摘 要 自从人类进入21世纪以后，网络正在以惊人的速度和影响力扩散到世界的各个角落，影响着社会生活的方方面面。网络资源共享已逐渐成为网络使用者的共识。这个连续在国家“十二五”、“十三五”规划中火热的新兴名词不仅极大的推动了社会的发展和改革，而且给人们的社会生活带来了极大便利。曾几何时，在国民经济中位居前列的是石油、金融和汽车产业，而如今，互联网行业却占据半壁江山。但任何事物都有利也有弊，互联网亦如此。互联网在方便人们生活和工作的同时也给人们带来了许多危害，也不可避免地给传统的各项权利和制度带来重大挑战，尤其资源共享与各项权利的专有性之间的冲突更加明显，同时也促进了法律的变革。网络让世界变成了社区，虚拟的世界让彼此陌生的人们产生了交集，让不同的地域联系越来越密切。网络由此引发了许多的法律问题。相对于传统的法律问题，网络法律案件有其特殊性，传统的法律难以解决这类网络难题，因而，加深对网络侵权的研究，制定新的法律就迫在眉睫了。众所周知，法律的目的是保护人们的人身财产权利，针对网络侵权案件逐渐增多的社会现实，为了更好地促进法律的完善，这便是本文的写作目的。在结合以往的网络侵权案例和当前法律的规定，在分析各种法学观点的基础上，总结出处理网络侵权案件的经验和不足，通过自己的分析和总结，为涉及网络侵权的纠纷处理和法律完善提供一些有益的意见。 关键词：互联网 网络侵权 侵权类型 完善 Abstract After entering the 21st century, the Internet is spreading to every corner of the world at an alarming rate and amazing influence, it has affected all aspects of social life. Network resource sharing has gradually become the consensus of the network users. This continuous hot new word in country’s “twelfth five-year paln”and “thirteen five-year paln ” not only it greatly promoted the development of society and reform, but also brought great convenience to peoples social life. Once upon a time, ranked at the top in the national economy are the oil, the financial and auto industry, but now, the Internet industry has occupied the half. But everything has two sides, the Internet is no exception. Internet brings convenience to peoples life and work and also bring a lot of harm to people at the same time ,and it also inevitably brings major challenges to the traditional system and var.iety rights, especially between the rights of exclusiveness and resource sharing, the conflict is more obvious. but it also promoted the revolution of the law. Network makes the world becomes a community, the virtual world makes strange people overlap,and it let different regional contact more and more closely.
