The Death Penalty and Human Rights
Human rights are those rights that all human beings should enjoy in reality.
The concept is one whose concrete content has evolved over time and diversified across space.

While the disappearance of the death penalty is a historical necessity, in China it remains a necessarymeasure to protect the basic human rights of ordinary citizens.
A correct understanding of the provisions of the present Criminal Law would make it possible for us to reduce the actual application of death penalty by 90% in five to ten years. With the easing of social conflict, China may really be able to cease using the death penalty in the future and thereby facilitate its disappearance.
Arguments for and against the abolition of the death penalty both reflect a demand for the protection of human rights
1.China is a participant in the UN International Covenant on Economic, Social and
Cultural Rights; it is clearly ordered in the first article of both this covenant and the
UN International Covenant on Civil and Political Rights .
2.Human rights are rights that should be enjoyed by all “humans.” It is same to say that “all are equal” should be the prime characteristic that differentiates “human rights” from other personal rights.
3.all peoples choose to retain or abolish the death penalty is to maintain a rational social order. For a rational social order not only has as its content the human rights that are enjoyed by all, but is itself a necessary social condition for each and every member of society to enjoy basic human rights.
Advocating the abolition of the death penalty will not always result in the protection of human rights.
Human rights, as a fundamental value of contemporary society, have universal significance.
Everything that exists will one day die out. Like everything else in the world, the death penalty as an objectively existing social phenomenon will also follow the path from emergence to disappearance
