Abstract As one of the basic rights protected by the Constitution, liberty of the press plays a significant role in the contemporary society governed by the rule of law. Meanwhile, the Constitution provides that the general right of personality and specific right of personality of citizens are protected as basic rights. The improper practice of the liberty of press leads to the press infringement of rights, which inevitably infringes upon the basic human rights of citizens. Yet, the mere emphasis on the private rights of citizens will hinder the proper exercise of the freedom of the press. It has been a common issue discussed by the people studying laws and people from the press and media on how to reach a balance between the freedom of the press and the private rights of citizens, that is, to fully exercise the liberty of the press without any infringement of the citizens right of personality. This article sets forth the manifestation and social significance of its violation. It explores the ways to balance the freedom and the infringement of the press by examining the causes of conflicts between them. Key words: Liberty of the press；The press infringement of rights；Press law 试论新闻自由与新闻侵权 随着信息技术的发展，新闻传播事业在社会上的作用也被越来越受到人们的广泛关注。新闻自由是现代民主社会确立的公民的基本自由之一，是指新闻机构工作人员为实现其为社会服务的功能，依法采访、写作、发表、出版新闻作品，不受非法控制、约束的权利，它对保障公民对政府的监督，保证政府听取民意、凝聚民智，保障公民的知情权，促进民主社会的发展具有极其重要的作用。新闻侵权是指报纸、杂志等故意或过失的刊登诽谤他人的新闻，造成受害人的名誉权等人格权损害的行为。近年来，随着新闻事业的不断发展，新闻侵权现象时有发生，新闻自由与新闻侵权之间的矛盾与冲突日益突显并严重影响着国家与社会的发展，因此寻求新闻自由与新闻侵权之间的平衡是我国发展过程中的重要课题。 一、平衡新闻自由与新闻侵权的重要性 （一）新闻自由对我国发展起到重要作用 在经济上，我国的经济模式是，在不进行实质性政治改革的情况下，凭借其大量的廉价劳动力重点发展制造业、建筑业等“重型”行业。由于这些行业对新闻媒体和法治环境的依赖度低，所以到目前为止这种经济发展模式还可以成功。然而，这一“重型”发展模式是不能持久的，我国现在的经济实际上已在挑战这一模式，新闻自由是中国经济未来增长的必要基础。政治上，大众传媒在建设和谐社会中扮演着极为重要的角色。它应该是民主法制的推动者、公平正义的呼吁者、安定有序氛围的营造者、人与自然和谐相处的传播者。如何发挥大众传媒对于构建社会主义和谐社会的这些功能，一个十分重要的课题是需要正确认识和把握新闻自由与控制问题。 总之，新闻自由不仅对政治民主十分必要，而且对我国经济的深化发展、矫正经济腐败、促进市场交易也具有十分关键的作用。所以，新闻自由能够推动或改善我国发展所需要的条件，重视有关新闻自由的一系列经济、政治改革，对我国的发展能起到非常重要的作用。 （二）新闻侵权对社会的严重危害 由于新闻侵权是通过大众传媒来
