RESEARCH ON THE REPORT INCENTIVE PROTECTION MECHANISM ON FOOD SAFETY ABSTRACT This paper firstly analyzes the necessity of report incentive system on food safety. Through the report incentive protection system, the executive authorities stimulate the public to expose illegal acts so as to make up its lack of competence in discovering unlawful acts and investigation, that is, combating against food safety violations through cooperation between government and citizens. This paper will sort out the establishment and improvement of report incentive protection mechanisms on food safety in Shanghai, and compare the “Incentives” in 2012 and 2007. This paper will analyze the initial results of new “Incentives” in rewarding and protecting informers through comparing the data during March to August in 2012 and the same period in 2011 given by Shanghai Food and Drug Administration after the implementation of new “Incentives”. Based on the empirical comparison, the experience at home and abroad, and the experience of Taiwan in food safety reporting and rewards, this paper will put forward several suggestions for the improvement of protection mechanism: firstly, promote legislative protection for food safety exposure; secondly, define the range of protection in order to prevent rights abuse; thirdly, protect the legitimate rights and interests for informers; fourthly, give timely feedback to reportings.
