民航业限制竞争行为的法律规制课稿.docx

昆明理工大学 设计（论文）专用纸 PAGE  第  PAGE \* MERGEFORMAT 25页  摘 要 近几年来，民航业的诸多限制竞争行为引起了民众的广泛关注，限制竞争行为即垄断行为。在民航业，无论是售票系统、订票系统、地面服务系统，还是航油、航材等航空资源的贩卖，均有限制竞争行为的出现，具体表现为垄断协议、滥用市场支配地位、经营者集中等。我国规制民航业限制竞争行为的适用法律有《民航法》、《反垄断法》等，但其在规制航空业限制竞争行为方面还存在诸多不足的现状，例如法律体系不全、规范内容落后、执法力度不大等。借鉴美国和欧盟等国家成熟的相关法律规制，是完善我国限制竞争行为法律规制的要手段。 关键词：民航业；限制竞争行为；反垄断；规制 Abstract In recent years, many aviation industrys restrictive competition behavior has aroused widespread concern of people, economic and administrative both created the civil aviation industry has many limit competition behavior, in this paper, the author define the anti-competitive practice as monopolization, which is in violation of provisions of Competition Law, to seeking unjust benefit. In civil aviation, whether it is ticketing system, booking system, ground services, or vending resource like fuel, aircraft materials and so on, all include limit competition behavior. The specific performances are the monopoly agreement, the abuse of the dominant position of the market, the operator concentration. Regulation of limit competition behavior of civil aviation industry in China include the civil law, anti-monopoly law and so on, but both in the regulation of the airline industry limit competition behavior, there exist many shortage situation. The author will draw on the United States and the European Union limit competition related laws and regulations for the civil aviation industry, to Chinas civil law, anti-monopoly law perfect put forward their own proposals.
