第六届全国土木工程研究生学术论坛 清华大学 2008 我国建设单位在住宅工程中质量安全主体责任的研究 陈宇1 (1.同济大学土木工程系建筑工程系，上海 200092) 摘 要：建筑业是我国国民经济的重要支柱产业，为推动国民经济增长和社会全面发展做出了巨大的贡献。随着住房制 度改革的深化和住房商品化的积极推进，我国住宅建设规模巨大。作为国家重要的民生问题，住宅建设中的质量安全 问题存在许多亟待解决的问题。在我国，监管和法律等各环节都注重于施工环节，而对建设单位的责任主体的认识和 监管都未得到落实。同时在住宅工程中建设单位又作为一种“特殊”的业主出现。本文通过对文献理论研究、统计资 料的分析以及国内外的成功经验???着眼于分析和研究目前我国建设单位在住宅建设过程中存在的问题，力图分析问 题，提出解决的思路和对策，从而使工程质量安全责任落实到位，使建设单位作为第一责任人成为住宅建设工程质量 保证的主力军。 关键词：建设方；质量安全责任；业主负责制 The Research on Quality and Safety Responsibility of Chinese Project Owners in Residential Construction Chen Yu (Tongji University Civil Engineering, Shanghai 200092, China) Abstract: As the important mainstay industry in China, construction industry contributes much to the national economic growth and social overall development. With the evolution of the residential system and the positive advance of residential commercialization, the scale of Chinese residential construction is great. As a important problem of peoples livelihood issues, there are many problems about the quality and safety of residential construction which are urgent to be solved. In China, the supervisions or the laws focus much on the progress of construction, while the supervision and the recognization about the responsibility of project owners has not been implemented. Meanwhile, project owners in residential construction are a type of special owners. This paper studied theory and literature, refined the statistic analysis of Quality Supervision Station, contrasted the successful experience of China and Foreign.
