CALL TO ORDER Chair Fennell called the meeting to order at 10:42 a.m. B. ROLL CALL Directors Present: Stroeh, Marks, Hemphill (arrives at 10:45 a.m.), McCowen, Peters, Wagenet, Chair Fennell Directors Absent: Madrigal, Kelley Also Present: Executive Director Mitch Stogner, Legal Counsel Chris Neary, Legal Counsel Jennifer O’Brien, Recording Secretary Hiedy Torres C. AGENDA APPROVAL Upon Motion by Director Stroeh, seconded by Director Peters the Board approves Amended Agenda for addition of item E.6. Findings: Recent negotiations with The Judicial Council of California caused delay in publication of this agenda item. The need to take action arose after the publication of the agenda. Motion carried: AYES:7, NOES:0, ABSTAIN:0, ABSENT:2 D. PUBLIC COMMENT Mike Pechner- He said the NCRA Board needs to stand up to the SMART Board in regards to their “our way or no way” attitude. He said he feels that all involved parties, NCRA NWP, Co. would have less friction between them if NCRA took a more active role. He said it has been very hard for the freight railroad to get anything done with SMART. He said he is concerned about freight trains not running through Novato between the hours of 8 pm. and 7 a.m. (overnight hours) because of the constrained freight schedule when daytime commuter operations commence next year. E. CONDUCT OF BUSINESS Election of NCRA Board Officers for Calendar Year 2016 Upon Motion by Director McCowen, seconded by Director Hemphill the Board elected Director Peters as Chair of the Board for Calendar Year 2016.
