法律与文学的结缘 内容 摘要： 法律 与文学都是以人和 社会 为 研究 对象，以人为本，法律主要是规范人在社会中的行为，规范人的什么行为是违法，什么行为是犯罪；什么话可以说，什么话不能乱说；什么事情可以去做，什么事情不能去做；文学是人学，是怎样去写人、探索人和感化人的学问，是塑造人物形象的手段和行为方式；法律是用抽象思维方式进行的，文学是用形象思维方式进行的；法律与文学在叙述的人物对象上不一样，在修辞语言上不一样，在逻辑要求上也不一样。可以说所有的法律故事都是文学作品的素材，但不能说所有的文学作品都涉及法律。说法律创造文学，是因为法律故事成了文学素材的源泉；说文学修饰法律，是因为文学贯穿于人物成长的每一个阶段，文学能使枯燥无味的法律变得更加严谨，更加准确，更加人物化，更加丰富多彩，更加具有深邃的 历史 意义和社会现实意义，更加符合国家法治的要求。 关键词： 法律 文学 故事情节 语言 艺术 逻辑规范 The Relationship between the Law and the Literature Abstract：The law and the literature all take the human and the society as the research object and take the human as the foundation. The law mainly is the standard to adjust the person’s in society behavior. It tells people what behavior is illegal and what behavior is a kind of crime; what word may be said freely and what word can’t be spoken irresponsibly; what thing may be done and what thing can’t be done. The literature is a kind of study about the human. It is the kind of knowledge about how to describe, explore and influence human. It is the method and the behavior way that people portray the character image. The law is carried on with the abstract thinking way, while the literature is carried on with the concrete and vivid thinking way. The law and the literature are dissimilar on the character object that they narrate, in the rhetorical language and in the request to logic. We may say all legal stories all are the literary works’source material, but we can’t say all literary works all concern the law. To say the law creates the literature is because the legal story has become the fountainhead of the literature works’source material. To say the literature decorates the law is because the literature runs through the every stage that the character grows in.
