财产权利权能理论新拓展：理论框架 及其对中国当前集体农地权利体系的合理解释1 邹秀清2 熊玉梅3 尹朝华4 （2，4江西财经大学旅游与城市管理学院 3江西财经大学法学院 南昌 330032） 摘要：大陆法系传统所有权理论认为所有权权能包括占有、使用、收益和处分四项基本权能。 随着社会经济的发展，新的财产权类型不断涌现，传统所有权权能理论受到前所未有的挑战， 所有权权能如何拓展以适应社会经济发展的需要成为理论界和实务界当务之命题。本文提出 了权能支的新概念，认为四项基本权能是由若干权能支构成的集合，基本权能或权能支的分 离、重组和耦合形成新的财产权利类型。基于权能支的概念，本文建立了一个新的财产权利 权能结构理论框架，应用新的权能理论，对当前中国集体农地权利体系进行了合理解释，并 就现阶段土地承包经营权权能完善和拓展提出了政策建议。 关键词：财产权利；权能；权能支；权利束；集体农地 A new development of property rights theory: theoretical framework and its reasonable explanation towards China’s current property right systems of collective agricultural land Zou Xiuqing Xiong Yumei Yin Zhaohua (Jiangxi University of Finance Economics， Nanchang ， 330032) Abstract: In Civil Law ， the traditional ownership theory holds that the title includes four basic powers and functions of property rights such as possession ，use ，profit and disposition .With the social and economic development and the emergence of new property rights， the traditional ownership theory is facing up unprecedented challenges. How to develop the theory of the powers and functions of property rights to meet the new needs is becoming a top priority proposition in theory and practice. This paper develops a new concept of branches of property rights’ powers and functions . The basic idea of the new theory is that the four basic powers and functions of property rights are formed by a series of branches of property rights’ powers and functions， and the new types of property rights are formed through the separation ， reorganization and coupling of the basic powers and functions of property rights or their branches.
