( ) 　　　　　　　　　　　　　　　法律科学 西北政法学院学报 　　　　　　　　　2005 年第 2 期 ·20 · ( ) ( ) 　文章编号 :167 169 14 2005 020020 07 高校校规的违宪审查问题 胡肖华 ,徐 　靖 (湘潭大学法学院 ,湖南 湘潭 4 11105) [摘 　要] 　我国高校虽然不具有行政机关的资格 ,但法律赋予它行使一定的行政管理权 ,所以,我国高校校规 是一种自治规章 ,属于抽象行政行为 。大学生是国家的普通公民 ,享有宪法规定的权利 ,但现行司法体制在处理高 校校规侵犯大学生宪法权利的行为时存在许多缺憾 。为使高校管理法治化 ,高校校规必须接受违宪审查 。法院在 审查校规合宪性时应遵循一些原则 ,诸如法层级效力规则 、校规合宪性推定规则 、禁止歧视对等规则等 。 [ 关键词] 　高校校规 ;违宪审查 ;大学生 ;宪法权利 Abstract :Though t he higher schools in China do not possess t he qualification of administrative aut horities , t hey are entitled to certain executive power , t hus t he regulations of higher schools are autonomous ones , belonging to abstract ad ministrative act s. University student s are ordinary citizens , and t hey enjoy t he right s stipulated in t he Constitution , whereas , t here are many defect s in t he current j udicial system towards t he violation of university student s’right s endowed by t he Constitution . In order to make t he higher schools’administration ruled by law , t heir regulations shall accept t he review of constitutionality . The court s , while reviewing t he constitutionality of t he higher schools ’regulations , should follow t he principles hereinafter such as t he principles of different levels of t he validity of law , t he principle of t he con struction of t he constitutionality of higher schools’regulations and t he principle of prohibiting discriminative treat ment .
