This paper combed the male maternity leave in Chinas development history, present situation, analyzes the characteristics of male maternity leave in China. And combed the foreign male maternity leave the development history, present situation, illustrates the development trend of the foreign men maternity leave. According to the male maternity leave the basic situation of our country and abroad, from the concept, legislation and treatment issues, policy supporting a total of four aspects are discussed in this paper, puts forward suggestions to how to reform the male maternity leave in China and perfect the maternity insurance system.
