Abstract:In the democratic societ , once the disput es go into the frame of law , there must be legal basis. How ever,
where can w e find the law ? How can we detect the law from a large number of law s? How can we deal w ith the contradic-
t ions, wrongs, gaps and unconstitutional law s w hen we appl ing the law s? All of these questions are the problems about
the sources of law in jurisprudence. T he article classifies these quest ions from the perspectives of legal and the jurispru-
dence met hodologies. On one hand, the t pes of China sources of law s stem are anal zed from the position of positive
law; this process is the beginning of law application. On the other hand, we will be committed to resolving all kinds of
conflicts in the sources of law .
