贷款合同中借款人违约责任研究 中文摘要 贷款合同是目前我国货币借贷市场中最常见的一种消费借贷，与现实中的经济和社会生活联系密切。但由于我国法律对于贷款合同的制度设计不够完善，以及货币借贷市场中市场主体法律地位的不平等，导致了贷款合同中双方当事人权利义务的不平等，这不仅违背了民法确立当事人地位平等以及公平的基本原则，而且对于经济的健康发展起着一个负面影响。最为突出的就是贷款合同中违约责任的设计，在实务中引起了相当大的争议和讨论。文章选择借款人的角度，通过分析贷款合同中当事人的地位以及借款人违约责任的类型，参考我国对于这方面的立法实践，阐述了借款人的违约责任现状。然后结合对我国目前对于借款人违约责任在实务中比较有争议问题的探讨，尝试针对相关问题的解决提出合理的建议，以期对贷款合同中借款人违约责任制度的完善提出自己的观点。 关键词：违约责任；合同法；借款人权益 Researching on Borrower’s Liability for Breach of Loaning Contract [Abstract] In the loan contract is at present our country currency lending market one of the most common consumer lending and daily economic is closely related to economic and social life.
