:体育法的基本原则要解决体育法存在的正当性和自立性问题它不仅可以指导体育法律
规则, 也可以在法律 用冲突中发挥作用不仅可以成为体育法的条文, 也应当可以解释体育
法的规则研究认为体育法的基本原则应当是具备专业性的较高层级的, 覆盖面宽, 指导性
强,稳定性好和可 用的基本原则若要满足这些要求, 那么这些原则同时也应当会是公认的,
并具有 一定传统和内涵的本研究从体育实践和体育发展的角度以体育特殊性为标准确立体
育法的基本原则因此,在经过论证和取舍后, 本研究尝试提出超越我国5体育法6 文本的体育
法的基本原则,即奥林匹克主义原则, 公平竞赛原则, 和谐体育原则

Abstract: The fundamental principle of sports law should surport the legitimacy and independence
of sports law . It not only guided the legal rules, but also applied to the resolution of legal conflic-
tion. It can not only be the provisions of the sports law , also be able to interprete the legal rules.
Now , w e are preparing to revise our Sports Law , it is the just time to research such issus, and
it. s necessary. By logical analysis and case study, the author find some conclusions about sport s
law. s basic principles. It suggests that the basic principles of sports law should be professional,
high level, w ide coverage, w ell guidance, and good stability, and also to be applicable. To meet
these requirements, then these principles must be extensive recognized , and have certain trad-i
