2001年国际燃油污染损害民事责任公约 International Convention on civil liability for fuel pollution damage 2001 Article 1 Definition For the purposes of this convention: (1) vessel means any type of seagoing vessel and marine vessel. (two) person means any individual or partnership or any public or private institution, whether or not a legal person, including the state or any of its constituent parts. (three) owner of a ship means the owner of the ship, including the owner of the vessel, the bareboat charterer, the manager and the operator. (four) registered owner means one or more persons registered as owners of a ship, or one or more persons who own a ship without registration. However, when the ship is owned by the state and operated by the company registered in that country as the ships operator, the registered owner shall mean such company. (five) fuel means any hydrocarbon mineral oil, including lubricating oil, used or intended for the operation or propulsion of a ship, and any residue of such oil. (six) the Convention on civil liability refers to the Convention on international civil liability for oil pollution damage as amended in 1992. (seven) precautionary measures means any reasonable measure taken by any person after an accident to prevent or minimize pollution damage. (eight) accident means an event or series of events which have the same origin, causing pollution damage or causing serious and imminent threat to such damage. (nine) pollution damage means: Loss or damage caused by any 1. place of ship fuel escape or discharge of pollution in the boat, but the compensation for environmental damage (not including such damage, loss of profits), shall be limited to the actual take or will take reasonable measures and cost recovery; 2. costs of preventive measures and further losses or damage caused by preventive measures.
